1. The Site provides an interactive online service operated by EATIT, consisting primarily of the promotion and sale on behalf of certain specific customers (Sellers). As a result of your use of the Site, you agree that: you are an individual who has reached the age of 18; You contain the authority to form a legally binding agreement; Your use of this Site will at all times be in accordance with the terms of this Agreement; If you decide to create an account: You may only create an account for your own personal use; You may only make legitimate purchases that are in accordance with the letter and data of the terms of the relevant offers; You may only make purchases for your own personal use or entertainment, or, when offered as a gift to someone else; You must protect your password and monitor the use of your account, understand and agree that you are responsible for your own personal use and the use of your account by anyone you allow to have access to it. If you violate any of these restrictions, we may terminate your account and, without limitation, you may be subject to a suspension of current or future promotional credits. If we terminate your account, you may not re-apply or join under a new account unless we formally invite you. If you commit fraud or falsify information in connection with your use of the Site or in connection with your EATIT account, your account will be terminated immediately and we reserve the right to hold you liable for any and all damages resulting therefrom. In this way, we have the right to follow the actions provided for by law to notify the relevant law enforcement authorities and at the same time notify your ISP (Internet Service Provider) of any fraudulent activity related to you or your use of the Site.

7. Terms of Sale for purchases you make through our website: The relevant business is solely responsible for the execution of the purchase. The business in question is the provider of the product and bears full responsibility for the goods or services it offers you as well as for any damage to health or other action that may cause you dissatisfaction, directly or indirectly, during the entire process or part thereof, related to the process of providing the service. EATIT is the service intermediary connecting the business with the consumer on the website and the business in question is the sole provider of the product.

All opinions, advice, ratings, discussions, comments, and/or other messages or Comments of any kind made by you or any other user of the Communities are those of the respective author(s) or distributor(s) and not of EAT.

These links are provided solely as a convenience to you and not because we endorse or have any opinion regarding the content on such sites. We expressly disclaim any representations regarding the content or accuracy of the materials on such sites or the privacy practices offered by them. 13. You understand and agree that all postings are public and not private. Any other person (whether or not a user of EATIT's services) may read your postings without your knowledge. Please do not include any Personal Information in your postings. EATIT does not control or endorse any postings found in any part of the Communities, and specifically disclaims any liability in connection with postings and the Communities and also any actions resulting from your participation in any area of ​​the Communities including any objectionable content. You are solely responsible for your interactions with merchants and other users of the Site. To the extent permitted by applicable law, you hereby release EATIT from any and all claims or liabilities in connection with any product or service offered by merchants, any acts or omissions by merchants, including merchant’s failure to comply with applicable law and/or failure to adhere to EATIT’s terms, as well as any conduct or speech, whether online or offline, of any other user.

16. Termination: EATIT may terminate the Terms of Use at any time. Without limiting the foregoing, EATIT shall have the right to immediately terminate or suspend any of your passwords or accounts if EATIT considers, in its sole discretion, that any of your conduct is unacceptable, or if you violate this Agreement. Notwithstanding the foregoing, the Terms of Use shall survive any termination of this Agreement.

17. Choice of Law: Any dispute arising out of or relating to these Terms of Use, and/or any use of the Site by you, or the use of EATIT's services, will be governed by the laws in force in the territory of the Albanian state.

18. Additional Disclosure: No waiver by you or EATIT of any breach or failure to exercise any right granted under this Agreement shall be deemed a waiver of any liability for any breach committed or that may be committed in the future. If any section used herein is held invalid by a court of competent jurisdiction or institution, its invalidity will not affect the validity of the remainder of this Agreement. The other parts of our Agreement will continue in full force and effect.

19. We collect and process information/data from our Customers and/or Users for our purposes, such as providing and administering the Service. We never collect/process sensitive data as this is not technically permitted through the use of the Service.

19.1 Type of data in question When you first register for a Baboon account, and when you use the Service, we collect certain data about you as a Customer/User, such as: your full name, your email address, your phone number

19.2 Baboon uses Customer Personal Data for the following general purposes: to identify you when you log in to your account on the Service to enable us to operate the Service and provide it to you to verify your transactions and for purchase confirmation, billing, security and authentication to analyze the Site or Service and information about our visitors and users, including researching user demographics and behavior in order to improve our content and the Service to contact you regarding your account and to provide customer support, including responding to your comments and questions to keep you informed about the Service, features, surveys, newsletters, offers, contests and events that we think you may find useful or that you have requested from us to sell or market the Service to understand more better understand your needs, to diagnose problems, to analyze trends, to improve the features and use of the Services, and to better understand and market to our customers and users to keep the Service secure

21.2 Payment Security
We take the security of your payments seriously. All transactions are encrypted and processed through secure channels. However, we cannot guarantee absolute security and are not responsible for any unauthorized access or breach.

21.3 Payment Processing
Payments made through the mobile app are processed immediately. However, there may be delays due to technical issues or unforeseen circumstances. We are not responsible for any losses incurred due to delays in payment processing.

21.4 Refunds and Cancellations
Refunds and cancellations are subject to our refund policy, which can be found on our website or provided upon request. We reserve the right to refuse refunds or cancellations in certain cases.

21.5 Privacy
We respect your privacy and treat your personal information in accordance with our privacy policy. By using our online payment services, you consent to the collection and use of your information as described in the privacy policy.

21.6 Changes to the Terms

These agreements and terms are governed by the laws of Albania. Any dispute arising out of or relating to these terms will be subject to the exclusive jurisdiction of the courts in Albania.
